CITY OF BURLINGTON

KIT CARSON COUNTY

STATE OF COLORADO

NOTICE IS HEREBY GIVEN the City Council of the City of Burlington desires to amend certain portions of the Municipal Code, specifically Title 17 Zoning, to bring into compliance with Colorado Revised Statute 26.5-5-310 allowing for licensed family child care homes without restriction in residential zoning area.

The following changes to Title 17 are hereby necessary to comply with Colorado Revised Statute:

Title 17 Zoning, Chapter 17.08 Definitions is hereby amended to include Article 17.08.121, to read: “Family Child Care Home” means a type of family care home that provides less than twenty-four (24) hour care at any time for two (2) or more children that are unrelated to each other or the provider, and are cared for in a provider’s place of residence; and in a FCCH, care may be provided for six (6) children from birth to eighteen (18) years of age with no more than two (2) children under the age of two (2) years of age.

 Title 17 Zoning, Chapter 17.08 Definitions is hereby amended to include Article 17.08.122, to read: “Large Family Child Care Home” means a Family Child Care Home that provides less than twenty-four (24) hour care at any time for seven (7) to twelve (12) children from birth to eighteen (18) years of age with no more than two (2) children under the age of two (2) years of age.

 Title 17 Zoning, Chapter 17.20 Residential, Commercial and Industrial Districts, Article 1. Residential, 17.20.010 – Use regulations for R-1 district—Single-family residential is hereby amended to include A. Uses permitted by right 7. Family Child Care Home.

 Title 17 Zoning, Chapter 17.20 Residential, Commercial and Industrial Districts, Article 1. Residential, 17.20.010 – Use regulations for R-1 district—Single-family residential is hereby amended to include B. Uses permitted by special review 3. Day care centers (a.) Large Family Child Care Home.

 The City Council shall hold a Public Hearing at 6:30 P.M. on March 27, 2023, at the Burlington Community and Education Center, Room A, 340 S. 14th Street, Burlington, Colorado, to consider proposed changes to the existing zoning ordinances.

Any person may appear at the Public Hearing and present evidence and testimony upon any matter considered by the City Council. All petitions and protests may be filed in writing with the City Clerk’s Office, 415 15th St., Burlington, CO by Friday, March 24, 2023.
